| 《婚姻家庭编解释（二）》第8条的规范重心在于就父母为子女婚后出资所购房产在离婚时的价值分配提供相应考量因素。既有理论构成因割裂夫妻共同财产形成和父母出资行为之间的关系，难以完满解释该条规范内容。以将父母出资行为推定为向双方附解除条件赠与的规则为理论构成起点，当解除条件部分成就时，即发生父母出资价值部分返还请求权和剩余房产价值离婚分割的双层法效果。基于简化诉讼的考量，《婚姻家庭编解释（二）》第8条对该双层法效果进行了变通处理，未将父母作为诉讼当事人，但其所列举的因素仍须在双层法效果这一整体框架内进行妥当解释。 |

| The core focus of Article 8 of the Interpretation (Ⅱ) of the Marriage and Family Book of the Civil Code lies in providing relevant factors for the distribution of property value at the time of divorce when parents have contributed funds for the purchase of real estate after their child's marriage. Existing theoretical constructions fail to fully explain the provision's content due to their fragmented approach to address the relationship between the formation of marital community property and parental financial contributions. Starting from the theoretical premise that parental contributions should be presumed as conditional gifts to both spouses, the legal effects manifest in double dimensions when the condition for revocation is partially met: the parents may claim restitution of the contributed value, and the remaining property value is subject to division according to the divorce institution. To simplify litigation, Article 8 modifies this double legal effect by excluding parents as parties to the proceedings. However, the factors enumerated in the provision must still be properly interpreted within the overarching framework of this double legal effect. |
