| 老年妇女兼具“老年”和“妇女”的双重身份，需要受到特别的关注和照顾。随着社会的发展进步和老年人平均寿命的提高，老年人离婚率逐渐上升。老年人的离婚包括初婚离婚和再婚离婚两种各具特点的形态。由于年龄、身体状况、心理状况、就业情况、社会分工、家庭分工、思想观念、子女意见等各种因素的影响，老年妇女在离婚财产分割和离婚救济的案件中可能处于相对弱势的地位。在司法实践中，应当根据老年妇女的特殊需求与特征，对《民法典》《婚姻家庭编解释（一）》《婚姻家庭编解释（二）》中规定的离婚财产分割和离婚救济的法律规则进行有针对性的细化解释，以使其在个案的适用过程中将老年妇女的特殊利益纳入考量，从而有效关怀和保障老年妇女的合法权益。 |

| Elderly women, who have the dual identities of “the elderly” and “women”, warrant special attention and care. With the development of society and the increase in the average life expectancy of the elderly, the divorce rates among the elderly have been gradually rising. There are two distinct forms of divorce among the elderly: divorce in a first marriage and divorce in a remarriage. Due to various factors such as age, physical condition, mental state, employment status, social and familial roles, ideological concepts, and the opinions of adult children, elderly women may be in a relatively vulnerable position in cases concerning the divorce property division and the divorce remedies. In judicial practice, it is imperative to conduct a targeted and nuanced interpretation of the statutory rules on divorce property division and divorce remedies stipulated in the Civil Code and the Interpretations (Ⅰ) and (Ⅱ) of the Marriage and Family Book of the Civil Code. Such interpretation should be informed by the special needs and characteristics of elderly women. This ensures that their particular interests are taken into account in the application of the law in individual cases, thereby effectively safeguarding their legitimate rights. |
