| 当待决案件与指导性案例构成类似时，法官应当参照指导性案例实现类案类判。但在司法实践中，出现了待决案件与指导性案例类似而法官没有参照指导性案例、法官扩展适用指导性案例、法官隐性参照指导性案例、法官对当事人提出的参照指导性案例的请求未置可否，以及法官否认指导性案例作为上诉或再审理由等五种典型的适用失范现象。指导性案例在司法实践中适用失范现象会带来一系列消极影响与实践隐患。欲改善法官参照适用指导性案例适用失范的现状，最重要的措施是构筑起新颖、多维、精细化的指导性案例参照流程，为法官适用指导性案例实现类案类判提供参照技术支持。 |

| Abstract: |
| A judge shall make similar cases similar to referees by referring to the guiding cases when the pending case is similar to the guiding case. However， five typical application irregularities appear in judicial practice， such as： a pending case is similar to the guiding case but the judge does not refer to the guiding case; judges expand the application scope of guiding cases; judges implicitly refer to the guiding cases; judges are noncommittal in the partys request for referring to a guiding case; judges deny the guiding cases as the ground for appeal or retrial. At the same time， the guiding cases may bring a series of negative effects and hidden practical dangers. There are multiple reasons for the abnormal application of instructional cases. To solve the problem of the improper application of guiding cases by the judge， on the one hand， it is necessary to build a new， multi dimensional， and refined reference process for the guiding cases; on the other hand， it is necessary to establish an application mode of guiding cases. |
