| 低空经济的发展高度依赖数据要素的充分流通与高效配置。然而，当前数据产权制度建设仍处于探索阶段，抽象化的制度设计难以回应具体领域的特殊需求。应从数据产权制度构建的现实困境出发，探索领域化路径具有的必要性与正当性，并以低空经济为切入点，系统分析低空数据活动的独特属性及其对数据产权制度的特殊需求。在此基础上，提出构建低空经济数据产权制度的理论基础和价值目标，设计以分层确权机制、数据流转规则为核心的具体制度方案，以期为破解数据产权一般理论难题提供有益启示，为产业发展提供坚实的制度保障，从而推动我国数据法律制度体系的完善。 |

| The development of the low-altitude economy is highly dependent on the full circulation and efficient allocation of data elements. However, the current construction of data property rights systems remains in an exploratory stage, with abstract institutional designs struggling to address the specific needs of particular sectors. Starting from the practical dilemmas in constructing data property rights systems, this paper argues for the necessity and legitimacy of sector-specific exploration approaches. Taking the low-altitude economy as an entry point, this paper systematically analyzes the unique attributes of low-altitude data activities and their special requirements for data property rights systems. On this basis, the paper proposes the theoretical foundations and value objectives for constructing a data property rights system for the low-altitude economy, and designs specific institutional frameworks centered on layered rights confirmation mechanisms and data circulation rules. The aim is to provide solid institutional guarantees for industrial development, offer valuable insights for resolving the general theoretical dilemmas of data property rights, and thereby promote the improvement and development of China‘s data legal system. |
