著作权法与反不正当竞争法之间的关系,主要有“兜底保护”说、“补充保护”说和“平行保护”说三种学说分歧与实践差异。基于防止重叠保护、过度保护的现实需要,“平行保护”说理应成为著作权法与反不正当竞争法界分的最优选择。“平行保护”界分的底层逻辑是法益的区分保护原理。著作权法保护作品中的独创性表达,反不正当竞争法有条件地保护作品中的非独创性要素,前者之上产生绝对权,后者之上形成未上升为权利的法益,也就是《民法典》第126条中的“利益”。因此,尚在《著作权法》保护期内的作品和已超过《著作权法》保护期的作品均不应受《反不正当竞争法》保护,不具备独创性的作品要素仅在竞争法意义上获得《反不正当竞争法》的有限保护。 |

The Distinction between the “Parallel Protection” of Copyright Law and Anti-unfair Competition Law |

Abstract: |
The relationship between the Copyright Law and the Anti-Unfair Competition Law mainly involves three theoretical differences and practical variations: the “bottom-up protection” theory, the “supplementary protection” theory, and the “parallel protection” theory. Based on the practical need to prevent overlapping protection and excessive protection, the “parallel protection” theory should be the optimal choice for demarcating the boundaries between the Copyright Law and the Anti-Unfair Competition Law. Behind the distinction of “parallel protection”, there are various differences in the top-level design between the Copyright Law and the Anti-Unfair Competition Law. The underlying logic is the principle of differentiated protection of legal interests. The Copyright Law protects the original expressions in works, while the Anti-Unfair Competition Law conditionally protects the non-original elements in works. The former generates absolute rights, while the latter forms legal interests that have not yet ascended as rights, which is referred to as “interests” in Article 126 of the Civil Code. Therefore, both works within the protection period stipulated by the Copyright Law and those beyond the protection period of the Copyright Law should not be protected by the Anti-Unfair Competition Law. Works lacking originality only acquire limited protection under the Anti-Unfair Competition Law in the sense of competition law. |
