| BBNJ协定开放签署是近年来国际法领域的重要成果之一。该协定在为深海遗传资源开发法律秩序变革奠定基础的同时，也存在较多的模糊性建构。这意味着各国在执行阶段将继续围绕制度性话语权展开绵长的博弈。根据国际法的理论与经验，“软法之治”的重要性在BBNJ协定的执行阶段不容忽视，并成为国家之间争夺制度性话语权的重要维度之一。中国应当秉持人类命运共同体的理念，通过理论创新，不断提高自身主张的理性程度，从而推动国际法观念地层的迭代。通过融入海洋科研自由革新人类共同继承财产原则是理论创新的重要方面。同时，在BBNJ协定执行阶段，基于“软法之治”，借鉴“结构洞”理论的有益启示，中国可以在重要议题上努力弥合国家之间的罅隙。BBNJ协定的履约实践必将为中国构建制度性话语权积累可复制、可推广的经验与做法。 |

| On the Construction of Institutional Discursive Power in International Law from the Perspective of BBNJ Agreement |

| Abstract: |
| The opening of the BBNJ agreement for signature is one of the important achievements in the field of international law in recent years. While the agreement lays the foundation for the reform of the legal order for the exploitation of deep sea genetic resources, there are also many ambiguous constructions. This means that countries will continue to engage in a long competition around institutional discursive power in the implementation phase. According to the theory and experience of international law, the importance of “soft law governance” cannot be ignored in the implementation stage of the BBNJ agreement, and has become one of the important dimensions of the competition for institutional discursive power between countries. China should uphold the concept of a community with a shared future for mankind and continuously improve the rationality of its own propositions through theoretical innovation, so as to promote the iteration of the conceptual stratum of international law. It is an important aspect of theoretical innovation to innovate the principle of common inheritance of mankind through the integration of marine scientific research. At the same time, during the implementation phase of the BBNJ Agreement, based on the “rule of soft law” and drawing on the useful enlightenment of the “structural hole” theory, China can strive to bridge the gap between countries on important issues. The implementation of the BBNJ Agreement will surely accumulate replicable and generalizable experience and practices for China to construct institutional discursive power. |
