立足外部监管视角,平台是否需要为用户的行政违法责任认定承担主体责任是值得讨论的议题。以交通领域的平台经济为例,顺风车有别于网约车监管的属地性和便宜性导向,引发共享经济价值目标的偏移和执法实践的困境。作为公报案例的“曾海波案”试图为小客车合乘的行为定性、规范适用和责任追究机制提供参考,并通过信息服务和合乘服务主体的叠加、用户基于对政府平台监管的信任加持等理由,凸显合乘平台作为“承运人”对于承担外部监管关系中用户行政违法的主体责任。作为共享经济典型模式的顺风车监管,未来面临着监管规则和救济制度的完善。 |

The Identification of Platform's Responsibility in the Regulation of Shared Rides |

From an external regulatory perspective, it is worth discussing whether platforms need to bear the principal responsibility for the administrative legal liability of users. Taking the platform economy in the transportation sector as an example, the locality-based and cost-oriented regulation of ride-hailing services has led to a shift in the value goals of the sharing economy and a dilemma in enforcement practices. The “Zeng Haibo Case” serves as a public announcement case, aiming to provide reference for the definition, normative application, and liability pursuit mechanism of private car ridesharing. It also highlights the responsibility of ridesharing platforms as “carriers” in external regulatory relationships for bearing the administrative legal liability of users. The regulatory and relief system for private car ridesharing, a typical model of the sharing economy, faces the challenge of improvement in the future. |
