| 共同富裕作为高度凝练的政治话语与崇高的道德理想，只有转化为宪法上的权利与义务，进而通过权利、义务与法治的法学话语，才能阐明“共同富裕”的宪法意义与价值，并从纷繁复杂的政治话语中看清共同富裕所蕴涵的宪法意义与价值。因此，共同富裕实现问题必须以宪法为总依据，以宪法上的权利、权力与义务为支撑，构建基本权及其限定的基本框架与方法。“共同富裕”之“共同”在宪法上是表达了全体公民人人平等的价值、原则与权利；共同富裕之“富裕”在宪法上的表达则是公民自由权的保障与实现；“共享”发展理念是实质平等原则的具体体现，共享就由执政党的主张或政策载入《宪法》进而成为宪法原则，借助宪法文本关于“社会主义”“人权”“平等”等宪法条款的规范体系解释，成为一种新型的人权即共享权。实现共同富裕，国家需运用税收、社会保障与财政转移支付等再分配权力作再分配，因而这种再分配权作为国家重要的权力必须遵循均等化与法治化的原则，以此确保共同富裕实现方式的正当性与合法性。 |

| The Constitutional Expression of “Common Prosperity”： Freedom and Equal Sharing and Rule of Law |

| As a highly concise political discourse and lofty moral ideal, common prosperity can only be converted into the constitutional rights and obligations, and by the rights and obligations of legal discourse with the rule of law, in order to clarify the constitutional significance and value of “common prosperity”, and to see clearly the constitutional significance and value contained in common prosperity from the complicated political discourse. Therefore, the realization of common prosperity must be based on the constitution, supported by constitutional rights, powers and obligations, and build the basic framework and methods of basic rights and their limits. The “common” of “common prosperity” expresses the value, principle and right that all citizens are equal in constitution. The expression of “prosperity” of “common prosperity” in constitution is the guarantee and realization of civil freedom. The concept of “sharing” development is the concrete embodiment of the principle of substantive equality. Sharing becomes the principle of the constitution by writing the propositions or policies of the ruling party into the constitution. With the help of the normative system interpretation of constitutional provisions such as “socialism”, “human rights” and “equality” in the constitution text, it becomes a new kind of human rights, namely, sharing right. To achieve common prosperity, the state needs to use the redistribution power such as taxation, social security and financial transfer payment to make redistribution. Therefore, the redistribution power, as an important power of the state, must follow the principle of equality and rule of law, so as to ensure the legitimacy and legitimacy of the realization of common prosperity. |
