| 20世纪90年代以来，欧洲国家就以工作换取福利的发展型社会救助制度进行了诸多实践。为了减轻财政负担以及帮助受救助者重新融入有薪资报酬的劳动力市场，社会救助中强制要求有劳动能力者参加工作，且这种举措被不断强化，随之而来的侵犯受救助者基本权利的问题也逐渐受到越来越多的关注。在平衡二者关系的过程中，欧洲人权法院及各国地方法院的判例对受救助者基本权利的保护起到了重要作用。有鉴于此，在立足我国国情的基础上，提炼、考量、借鉴欧洲国家强制工作措施改革中具有通则性、普遍性的经验，对更好地保障我国社会救助制度中受救助者的基本权利具有重要的启示意义。 |

| On the Compulsory Work Measures in the Developmental Social Assistance System — Taking European Countries's Experience as a Mirror |

| Abstract: |
| Since the 1990s， the Western European countries have carried out many practices on the development oriented social assistance system that benefits from work. In order to alleviate the financial burden and help the rescued persons reintegrate into the paid for work labour market， the measure that forces workers with work ability to participate in work in social assistance is continuously strengthened， and the ensuing violation of the basic rights of the rescued persons is gradually receiving more and more attention. In the process of balancing the relationship between the two， the jurisprudence of the European Court of Human Rights and the local courts played an important role in the protection of the basic rights of the rescued persons. In view of this， on the basis of Chinese state of the nation， our social assistance system could extract， consider and learn from the experience of generalization and universality in the reform of compulsory work measures in Western European countries， which has important enlightenment to better protect the basic rights of the rescued in our social assistance system. |
