保护作品完整权的侵权判断标准分为有违作品的思想和有损作者的声誉两种。我国著作权法移植作者权体系的二元论模式,但司法实践突破立法引入了版权体系的声誉标准,争议的实质是如何平衡作者和作品利用方的利益。伯尔尼公约就两大法系的差异没有实质性作为,但在原则性的框架下提供有限度的保护已经成为比较法上的共识。建议否弃声誉标准,确立作品思想标准加合理限度内的改动作为侵权例外的模式。通过作品符号的结构化解析划分核心表达要素和非核心表达要素,作品的思想可以简化为对核心表达要素及其相互关系的判断,为侵权判定提供参考。 |

Criteria of Infringement of the Right to Integrity |

Abstract: |
There are two criteria of infringement of the right to integrity: criterion of the idea of works, and criterion of the reputation of authors. Chinese Copyright Law transplanted the dualism model of the authors rights system, but whose judicial practice broke through the provisions of legislation and introduced the reputation criterion of the copyright system. The essence of the disputes between the two criteria is how to balance the interests of the author and the user of the work. The Berne Convention has no substantive construction on the differences between the two systems, but it has become a consensus in comparative law to provide limited protection under the principled framework. It is recommended that criterion of the reputation of authors should be abandoned, and the mode of criterion of the idea of works plus necessary changes within reasonable limits as an exception should be adopted. Through the structured analysis of the symbol of the work, the core expression elements and non core expression elements are divided. Thus, the idea of the work can be simplified to judge the core expression elements and its interrelationships, which can be a reference for the judgement of infringement of the right to integrity. |
