| 证据裁判原则要求案件事实的认定须依证据，是刑事诉讼需遵循的基本原则。然而在数字时代下，证据载体从物理形态向数字形态转变，司法需求从个案公正向整体效率与安全拓展，使得证据裁判原则的适用环境发生变化。证据裁判原则也相应地面临着证据关联性认定不易、证据真实性审查繁难、证据合法性保障乏力等方面的挑战。面对数字困境，证据裁判原则应在坚守其基本价值取向和核心要求的前提下，在制度和规范层面做必要的更新。具体而言，可以从细化证据审查标准、改造证据审查方式、更新案件事实认定方法、完善制度保障四个方面着手，以应对挑战，促进证据裁判原则对数字时代的适应。 |

| The evidence-based adjudication principle, which requires the determination of case facts to be based on evidence, is a fundamental principle to be followed in criminal procedure. However, in the digital era, the carrier of evidence has transformed from a physical form to a digital form, and judicial needs have expanded from individual case justice to overall efficiency and security. These changes have led to a transformation in the application environment of the evidence-based adjudication principle. Consequently, the evidence-based adjudication principle is facing challenges such as difficulties in identifying the relevance of evidence, troubles in examining the authenticity of evidence, and weaknesses in ensuring the legality of evidence. Facing the digital dilemmas, the evidence-based adjudication principle should undergo necessary updates at the institutional and normative levels on the premise of adhering to its basic value orientation and core requirements. Specifically, efforts could be made from four aspects: refining the standards for evidence examination, reforming the methods of evidence examination, updating the methods for determining case facts, and improving institutional guarantees. These measures aim to address these challenges and promote the adaptation of the evidence based adjudication principle to the digital era. |
