蒸馏技术在大幅优化模型训练效能的同时,面临知识产权正当性的挑战。模型蒸馏的本质是对公共领域知识的创造性转化,所以公共领域理论为这一争议提供了有益见解。随着知识生产的经济成本结构发生变革性重塑,以及面对技术后发追赶和非线性创新的产业发展诉求,蒸馏技术驱动的知识共享机制正凸显其时代意义。蒸馏技术契合知识产权制度之技术进步和利益平衡的公共领域价值追求,在性质上属于知识产权公共领域的权能例外。为平衡公域知识之充分利用与循环生产之间的张力,宜构建“三位一体”的法律调节模式: 以合同对价补偿机制来维持公共领域的扩张动能、以反不正当竞争法来遏制不当利用公共领域的非法仿冒行为、以反垄断法来保障公共领域要素的自由流动,由此推动蒸馏技术健康有序发展。 |

Abstract: |
While distillation technology significantly enhances AI model training efficiency, it raises critical intellectual property (IP) compliance challenges. At its essence, model distillation represents a creative reworking of public domain knowledge, a process where public domain theory offers crucial interpretative frameworks. Amid transformative shifts in the economic architecture of knowledge production and growing industrial imperatives for technological leapfrogging and nonlinear innovation, distillation-driven knowledge-sharing mechanisms have gained strategic relevance. Knowledge distillation aligns with the public domain values of IP systems in promoting technological progress and balancing interests, constituting by nature a permissible exception within the IP public domain framework. To reconcile the tension between maximizing public knowledge utilization and sustaining its regeneration, a tripartite legal framework proves essential: contractual compensation mechanisms to fuel public domain expansion, anti-unfair competition laws to curb illegal imitation, and anti-monopoly regulations to ensure the unimpeded flow of public domain elements—collectively fostering the responsible evolution of distillation technology. |
