人工智能生成内容的权利归属分析可由“作品中心范式”转向“作者身份归因”。要想解决创作过程复杂化带来的作者身份不确定性问题,可通过因果关系理论形成连贯一致的解释。借鉴侵权法“法律因果”与“事实因果”的二分框架,可以将作者身份相应地解构为“创作意图”与“执行控制”。“创作意图”要求主体具备意志性、意向性与可预见性,“执行控制”要求创作行为符合“but-for”标准或“NESS”标准。将上述框架应用于人工智能生成内容的作者身份检验,程序设计者无法通过因果检验,人工智能不是合适的因果判定对象,使用人在对生成内容“充分描绘”的情境下具有作者身份的适格性。 |

Review of Rights Attribution of AI Generated Content: From the Perspective of Authorship Attribution |

Abstract: |
The rights attribution analysis of AI-generated content can shift from “workcentric paradigm” to “authorship attribution”. To solve the uncertainty of authorship caused by the complexity of creative process, a coherent explanation can be formed through causality theory. Drawing on the dichotomy frame of “legal causation” and “factual causation” in tort law, authorship can be deconstructed into “creative intention” and “executive control” accordingly. “Creative intention” requires the subject to have will, intentionality and foreseeability, and “executive control” requires the creative behavior to conform to the “but-for” standard or “NESS” standard. Applying the above framework to identity the author of AIGC, the program designer cannot pass the causality test, artificial intelligence is not a suitable object of causal judgment, and the user has the authorship eligibility under the situation of “fully describing” of the generated content. |
