| 当前，低空经济政策是我国地方政府推动低空经济发展的重要制度动力，并为低空经济的法治转化提供了低空空间改革开放、空域资源合理使用以及政府简政放权等法治意蕴。但随着我国地方政府所出台的29份低空经济政策（立法）的深入实施，低空经济政策的法治转化也暴露出政策思维与法律思维的协调性矛盾、政府调控与市场经济的主导性矛盾、政策开放与既有法律的制度性矛盾。为了更好地推进低空经济的法治保障，我国应当以“有限赋权”的理念来构建低空空域监管制度，构建以“开放竞争”为主导的低空经济制度，并建立低空经济的权益保障制度，从而实现低空经济的高质量发展。 |

| On the Legal Protection of Low Altitude Economy from the Perspective of Law and Policy Studies |

| Abstract: |
| Currently, low altitude economic policies are an important institutional driving force for local governments in China to promote the development of low altitude economy, and provide legal implications for the legal transformation of low altitude economy, such as low altitude space reform and opening up, rational use of airspace resources, and government streamlining and delegating power. However, with the deepening implementation of 29 low altitude economic policies (legislation) issued by local governments in China the legal transformation of low altitude economic policies has also exposed the coordination contradiction between policy thinking and legal thinking, the dominant contradiction between government regulation and market economy, and the institutional contradiction between policy openness and existing laws. In order to better promote the legal protection of low altitude economy, China should construct a low altitude airspace supervision system based on the concept of “limited empowerment”, and establish a low altitude economic system dominated by “open competition”, and establish a system for safeguarding the rights and interests of the low altitude economy, so as to achieve high-quality development of the low altitude economy. |
