普惠金融纠纷已成为数字化源头治理的重点领域。普惠金融的不良贷款率上升,已接近不良贷款率的容忍限度。因此,既要从本源上诊断该类矛盾的成因,又要关注不良处置存在的挑战。数字化对社会联结的再定义,因其具有深刻鲜明的动态性、精准性、协同性特性,故可以有效提高普惠金融的风险防控和不良资产处置效率。数字化不仅影响了普惠金融纠纷治理的主体之间关系,而且亟须进一步完成普惠金融矛盾治理的范式转型,包括“宽框架”的双体系协同、全链条的数字化平台构建、司法裁判指引的功能定位。当然,普惠金融矛盾的解决需要完善社会化协同的宏观治理体系,创新普惠导向的微观治理机制。其中,数字化源头治理需要从供给侧、需求侧和外部环境等多个维度出发,通过创新和改革来解决现存的挑战。 |

Source Governance of Digital Justice for Inclusive Finance |

Abstract: |
Inclusive finance disputes have become the important area of digital management. Given the rise of non-performing loans (NPLs) in inclusive finance, which is close to the tolerance limit of NPL rates, it is important to both diagnose the causes of such conflicts at source and focus on the challenges of non-performing dispositions. The redefinition of social connectivity by digitalization, with its profoundly distinctive shifting, particulate, and platform characteristics, can effectively optimize the risk prevention and control of inclusive finance and the efficiency of NPL disposal. Digitalization not only affects the inter-subjective relationship of inclusive financial governance, but also urgently needs to further complete the digital paradigm shift of conflict governance. This includes the synergy of the dual system of the “broad framework”, the construction of the digital platform of the whole chain, and the positioning of the function of judicial decision guidance. Of course, to solve the contradictions of inclusive finance, it is necessary to improve the macro-governance system of socialized synergy and innovate the micro-governance mechanism of inclusive orientation. Among them, the digitalized source governance needs to address the existing challenges through innovation and reform from multiple dimensions, including the supply side, the demand side and the external environment. |
