相较于既往的纠纷解决理念,诉源治理在高效便民的基础上进一步强调权利保障以及寻求和谐的理念指向。诉源治理立足“枫桥经验”以及多元化纠纷解决机制的资源禀赋,成为当下纠纷解决的鲜明导向。但实践中存在背离其初设理念的偏差,表现在调解前置的范围界定、分流程序的具体设置、数字化技术的介入程度等方面,均呈现出了明显的实践差序。因此,需要从其基本范式层面进行一定的革新,以此实现对诉源治理初设理念的守正。而“双层联动”的纠纷解决范式将诉源治理的理念内化其中,不仅能够回应当下纠纷解决的全新需求,也能够在强化制度供给、数字化赋能以及三治融合的基础上,形塑规范化、系统化的纠纷解决机制及其程序,进而促使纠纷解决迈向现代化发展之路。 |

Abstract: |
Compared with the traditional concept of dispute resolution, litigation source governance further emphasizes the philosophy of protecting rights and seeking harmony based on high efficiency and convenience. Based on the “Fengqiao experience” and the resource endowment of diversified dispute resolution mechanism, litigation source governance has become a clear direction for current dispute resolution. Under this guidance, various regions have made beneficial explorations into the practice of dispute resolution. However, in practice, there is a deviation from the original concept, which is manifested in the definition of the scope of mediation, the specific setting of diversion procedures, and the degree of involvement of digital technology, showing an obvious difference. So there is a need for some kind of innovation at the level of its basic paradigm, in order to realize the right direction of the governance philosophy of the source of litigation. The “two tier linkage” dispute resolution paradigm internalizes the philosophy of litigation source governance, which not only responds to the new demand of current dispute resolution, but also forms a standardized and systematic dispute resolution mechanism and procedure on the basis of strengthening institutional supply, digital empowerment and the integration of three governance, so as to promote dispute resolution to the road of modern development. |
