| 准确理解《生态环境法典》目的条款中的“生态环境权益”是有效实施法典的观念基础。在实践法理学基本范畴体系下，法律中的权益是法权的存在形式之一。根据权益的实质内容是个人利益还是公共利益，可以将其区分为权利和权力。不存在和法权并列的、不同于法权的法律保障的利益。法典所保障的生态环境权益包括两部分内容： 一是直接以公共生态环境利益为内容的权益，在法典中以权力的形式呈现，具体表现为各级各类国家机关的职权或权限，其中主要是行政机关的职权；二是与公共生态环境利益有间接关系的权益，具体表现为公民及其派生主体参与和监督生态环境保护的权利。上述各类法权的有效行使是实现法典立法目的的保证。 |

| Abstract: |
| An accurate understanding of “Ecological and Environmental Quan and Interests” within the purpose clause of the Ecological and Environmental Code is the conceptual foundation for the effective implementation of the Code. Under the framework of the basic categories of practical jurisprudence, “Quan and Interests” in law constitute one of the existential forms of faquan. Based on whether the substantive content of such “Quan and Interests” is private interest or public interest, they can be categorized into rights and powers. There are no legally protected interests that exist alongside or distinct from faquan. The ecological and environmental “Quan and Interests” protected by the Code consist of two components: (1) “Quan and Interests ” with public ecological and environmental interests as their direct content, which are manifested in the Code as “powers”, specifically the functions and powers or authorities of state organs at various levels, primarily administrative authorities;（2） “Quan and Interests” related to public ecological and environmental interests, which are manifested as the “rights” of citizens and their derivative subjects to participate in and supervise ecological and environmental protection. The effective exercise of the aforementioned various types of faquan is the guarantee for achieving the legislative purposes of the Code. |
