| 地方政府“内卷式”竞争是制约全国统一大市场建设与经济高质量发展的突出障碍,总体上属于滥用行政权力排除、限制竞争的行为。公平竞争制度以公平竞争审查与行政性垄断规制为双支柱,构成治理地方政府“内卷式”竞争的核心法治路径。地方政府“内卷式”竞争集中表现为招商引资恶性比拼、产业布局同质化与地方保护市场分割,其治理依赖源头预防与事后矫正的协同发力。公平竞争审查承担事前预防功能,可有效规制违法财税优惠、选择性补贴与新型“基金招商”内卷;行政性垄断规制发挥事后矫正作用,能够查处滥用行政权力设置市场壁垒、破坏竞争秩序的行为。通过程序衔接、标准统一、责任联动与跨区域协同,可形成“事前审查—事后执法—协同保障”的全链条实施机制,为强化竞争政策基础地位、破除地方保护与市场分割、深入整治地方政府“内卷式”竞争提供制度支撑。 |

| The Implementation Mechanism of Fair Competition System in Addressing the “Involutionary” Competition Among Local Governments—A Dual Perspective Based on Fair Competition Review and Regulation of Administrative Monopolies |

| The “involution-style” competition among local governments is a prominent obstacle to the construction of a unified national market and high-quality economic development. In essence, it constitutes an act of administrative monopoly involving the abuse of administrative power to exclude or restrict competition. The fair competition system, with its two pillars—fair competition review and administrative monopoly regulation—forms the core legal pathway for rectifying this “involution-style” competition. Such competition is manifested primarily in vicious bidding wars for investment, homogeneous industrial layouts, and market segmentation due to local protectionism; its governance relies on the synergistic efforts of source prevention and ex-post correction. The fair competition review undertakes the function of ex-ante prevention, effectively regulating illegal fiscal and tax preferences, selective subsidies, and the new form of “involution” via fund-based investment attraction. Conversely, administrative monopoly regulation plays the role of ex-post correction, investigating and punishing acts that abuse administrative power to set up market barriers and disrupt competitive order. Through procedural coordination, unified standards, linked accountability, and cross-regional collaboration, a full-chain implementation mechanism of “ex-ante review—ex-post enforcement—collaborative guarantee” can be established. This provides institutional support for strengthening the fundamental status of competition policy, dismantling local protectionism and market segmentation, and deeply rectifying the “involution-style” competition of local governments. |
