| Digital transformation is reshaping China's judicial system, with the trend of judicial adjudication shifting towards a human-machine collaborative model being particularly prominent. Take the pilot program for assessing the social danger of criminal suspects as an example. The introduction of artificial intelligence technology requires the construction of an assessment model before decision-making. For routine cases, machines are relied upon for quick adjudication, while for special cases, human judgment is combined with in-depth reasoning. Although this human-machine collaborative model enhances efficiency, it also brings challenges such as ambiguous defense targets and uncertain outcomes. At the same time, criminal defense is expected to undergo changes at both the content and effect levels, specifically in algorithmic defense. In the future, defense lawyers should deeply analyze case details, collect evidence to question the specificity of cases and the scientific nature of machine predictions, and initiate manual reviews for specific cases, while proposing algorithm optimization suggestions for similar cases. These changes not only accelerate the full coverage of the criminal defense process but also profoundly influence defense theories, promoting their development towards a more scientific and reasonable direction. In the future, the criminal defense market will be dominated by compound talents who master both legal and technical knowledge. They will provide precise and efficient defense services for clients within the framework of digital justice, ensuring the coexistence of judicial fairness and efficiency. |
