| 基于平台内势力的滥用行为呈现出与滥用市场支配地位不同的表现形式与竞争损害，是引发平台经济领域“内卷式”竞争的重要原因。以平台内流量控制、数据与算法滥用、平台不合理规则等为代表的滥用平台内势力行为，其复杂成因需从数字平台内的流量分配机制、平台数据与算法优势、平台规则制定权等多个方面剖析。针对滥用平台内势力行为的监管需打破对传统结构性指标的依赖，关注该行为的新特征、新后果，规范平台内规则体系的建设，重新审视、界定不同商业模式下的平台责任，从而构建多种法律法规协同一致的监管体系，引导我国平台经济实现互利共赢的高质量发展。 |

| Abstract: |
| Abusing intra-platform power exhibits distinct manifestations and competitive detriments, compared with the abuse of dominant market positions. It has become a significant catalyst for the “involutionary” competition in the platform economy. Intra-platform power might be abused based on platforms' intra-platform traffic control, misuse of data and algorithms, and unreasonable platform regulations. Its etiology is multifaceted, and necessitates a comprehensive dissection from various perspectives, including the traffic allocation mechanism within digital platforms, the data and algorithmic advantages held by platforms, and the authority to establish platform rules. Regulation targeting the abuse of intra-platform power must transcend the reliance on traditional structural index, and focus on the novel characteristics and ramifications of such behaviors. It is proposed to standardize the construction of intra-platform rule systems, to re-evaluate and delineate platform responsibilities under diverse business models, and to forge a regulatory framework that can ensure harmonious consistency among different laws and regulations. As such, China's platform economy would be steered toward high-quality development, with mutual benefit for all participating parties . |
